The EU data protection laws prohibits EU based company (also non-EU owned companies) from transferring private data from their employees or customers to countries considered to have inadequate privacy laws including United States.
EU and the US have agreed on the Safe Harbor to ensure that data can continue to flow, but it is only lawful to transfer private data to US if the receiving end complies with the Safe Harbor agreement.
